Federal Judge Orders Freedom of Abrego Garcia from Immigration Detention

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without legal authority.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a erroneous removal to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer alien smuggling charges, he was held in immigration detention.

In her decision, the judge noted that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

The court challenge involve disputed claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.
